Medical Went Schedule III. Recreational Didn't, Yet.

In April, the DEA finalized a rule moving marijuana sold through state-licensed medical programs, along with FDA-approved marijuana products, from Schedule I to Schedule III. It's the first change to marijuana's federal status since the Controlled Substances Act was written in 1970.

Everything outside those programs is still Schedule I. This summer the DEA held a hearing on moving all marijuana to Schedule III. A decision is still pending.

What it means for you

If you're a medical patient, the marijuana your state program sells is now Schedule III. If you buy recreational, nothing has changed federally yet.

Also in June: the Supreme Court ruled that using marijuana, on its own, isn't enough for the federal government to charge someone with illegally owning a gun. People who are intoxicated, addicted or shown to be dangerous can still be charged.

02

Hemp THC Gets Banned On December 11.

Last fall, Congress rewrote the federal definition of hemp. Starting December 11, most hemp products with intoxicating THC are no longer legal under federal law. That includes most delta-8, THCa flower and many THC drinks.

The ban was supposed to start November 12 and got pushed back a month. Several bills in Congress would regulate these products instead of banning them, so this one could still change. States can set their own rules too.

What it means for you

If you buy THCa flower or delta-8 online, expect availability and shipping to change fast after December 11.

03

What Voters Decided On November 3.

Cannabis was on the ballot in two states and one big city this year.

Massachusetts

Question 8

Would end recreational sales. Possession would stay legal.

Idaho

HJR 4

Gives the legislature sole say over legalization, ending voter initiatives on it.

[RESULT]
Houston, TX

Proposition A

Makes misdemeanor possession the lowest police priority.

04

Florida Stays Medical‑Only.

Florida's adult-use amendment gathered more than a million signatures. After a fight over signatures that were thrown out, the state Supreme Court declined to step in, and the amendment missed the 2026 ballot.

Close to home

We're a Florida company, so we're watching this one. For now, medical is the only legal path in the state.

05

The 2026 Scoreboard.

24States with legal adult use
41States with medical programs
2027Virginia retail sales begin July 1

Also this year: Illinois raised its possession limits, and Georgia expanded its medical program.

06

Medicare Is Covering Hemp.

A new federal program lets eligible Medicare patients get up to $500 a year in hemp and CBD products. It's aimed at people with qualifying medical conditions, and the details are still rolling out.

What it means for you

If you're on Medicare and manage a condition with CBD, ask your doctor whether you qualify.

07

Heading Home For Thanksgiving?

Rescheduling didn't change the travel rules for recreational cannabis. Before you pack:

  • Flying with cannabis is still federally illegal, even between two legal states.
  • Carrying it across state lines is too, even by car.
  • The rules where you're headed may be stricter than at home.

The easy move

Enjoy it at home, and check the local rules wherever you're spending the holiday.

The Laws Changed.
Harsh Smoke Didn't.

Every Freeze Pipe piece has a freezable glycerin coil that cools smoke by 300 degrees before it reaches you. Smoother pulls, less coughing, built to last.

This recap is general information, not legal advice. Laws change often and vary by state. Last updated November 2026.
